Who can file under Louisiana law?

Louisiana law states that the surviving spouse or children of the deceased can file a wrongful death claim. If there are no surviving spouse or children, then the surviving parent or parents can file a claim. If there are no surviving parents, the surviving siblings can file a claim. If there are no surviving siblings then the surviving grandparents of the deceased can file  a wrongful death claim. If there aren't any surviving family members related to the deceased victim, then the estate of the deceased may bring forth a claim to the court.
